Sales Policy
- JAL sells its products under different categories like direct sales to OEMs, consumers/ actual users, Government / Public sector companies against specific orders with mutually acceptable techno commercial arrangements.
- Sales also take place through an extensive dealer network spread across the country.
- JAL depots and consignment agents located in some of the major cities also supply ready stock which is subject to availability.
- Sale to the international market is executed either through agents appointed in some countries or through direct negotiations with the customers and procurement of orders from them. Repeat and regular orders are also obtained from satisfied international customers. There is a choice between mill finish, anodized finish or powder coated finish which the clients can procure as per their choice. JAL also develops new dies for various applications as desired by the customer.
General Terms and Conditions for Domestic Sale.
- Price – Price of Products is normally quoted ex-works unless stated otherwise, and is exclusive of Excise Duty, VAT, CST, Freight, Insurance, Octroi or any other government/ municipal levy which would be charged extra on actuals as applicable at the time of effecting delivery, regardless of the delivery period mentioned in the Purchase Order of the customer.
- Price Variation – Aluminium extrusion prices are governed by basic metal price of primary producers and hence all sales are subject to price variation clause, Price on date of despatch shall prevail.
- Excise Duty – The current effective rate of excise duty is 8.24%, advalorem and is applicable on the basic rate and packaging charges.
- Sales Tax/ VAT – The current rate of VAT (in Karnataka) is 4% and CST is 2%. Concessional rate of CST @ 2% will be levied if the customer submits ‘C’ form.
- Weight – The weight recorded at JAL’s factory scale will be considered as final.
- Quality Tolerance – JAL can supply goods with a quality tolerance of minimum + / - 10% for each section.
- Tolerance & Specification – The material ordered for shall be supplied according to IS specifications unless specified otherwise and agreed. In case of any oversight in the description of the material requirement by the buyer, he shall not be entitled to repudiate the agreement of sale or claim damages.
- Delivery Schedule – The material is delivered usually within 2 weeks for existing dies and 4 weeks for new dies, from the date of acceptance of the order and needs to be confirmed at the time of ordering.
- Payment Terms – All payments are to be made by means of a Demand Draft drawn on Jindal Aluminium Limited, payable at Bangalore. The DD charges are to be borne by the buyer.
- Inspection and rejection – Inspection of the goods can be carried out at the premises of JAL prior to despatch.
- Packing – Packing charges depending on the mode of packing would be extra, as applicable.
- Transportation – The material ordered can be despatched through the transport designated by the customer. However, in the absence of such instructions, the goods are despatched through any reputed transporter on freight to pay basis.
- Change of Order – Any variation or cancellation pertaining to the Purchase Order should be intimated well in advance, prior to the date of delivery, provided the item has not been extruded. The buyer shall be liable for any loss incurred by the company by way of such an alteration/ cancellation of the order.
- Indemnity – The buyer shall indemnify the company against all damages, penalties, costs and expenses to which the company may become liable to as a result of work done according to the buyer’s specification, involving the infringement of letters or registered design/Trademarks/Patents.
- Warranty – No warranty, expressed or implied is given as to the life or wear and tear of the goods supplied, nor is it stated that they will be fit for any particular purpose or for use under any specified condition not withstanding that such purpose or condition may be known to the company.
- Demurrage – All demurrage charges incurred due to non-clearance of material on time after its arrival at the destination or for any other reason shall be borne by the buyer.
- Jurisdiction – All contracts between the buyers and the company are deemed to be entered into at Bangalore and therefore are subject to the jurisdiction of courts at Bangalore.
- General – Any order placed with JAL against any quotation implies that the customer has read and accepted the specified terms and conditions. At the time of placing the order, the buyer is requested to furnish the full details such as alloy, temper/ chemical composition, physical properties, necessary drawings, sample component and end use of our suitable selection of raw materials and process.
Terms And Conditions For Developing New Dies – General
- New dies can be developed against security for New Die (SND) to be deposited by the customer.
- The amount of (Security for New Die) SND will vary depending on the types of profiles and whether the die has to be kept exclusive to the buyer. The exact SND will be informed while submitting the offer.
- The SND would be refunded to the buyer if the stipulated minimum quantity of extrusions is bought within a stipulated period. If the minimum stipulated quantity is not taken within the stipulated period, the SND would be forfeited.
- The minimum first lot supply for any new die would be 500/1000 kg.
Terms And Conditions For Developing New Dies – Exclusive
The dies are developed for the customers on an Exclusive Basis as well which means that materials against that particular Die will not be supplied to any other customer for the next two years.
